Description of Services

MainStreetLens is an informational tool that analyzes potential business locations and provides market insights to help guide entrepreneurial decisions. You enter a location (zip code or address) and a business type, select a search radius, and receive a MainStreetLens Success Score (0–10) along with detailed analysis reports, heat maps, and comparative data. You can save and compare multiple location analyses over time. However, our analysis does not guarantee accuracy or completeness, does not constitute legal, financial, tax, or real estate advice, and does not represent that any location will be profitable or suitable for your business. We do not conduct physical inspections or on-the-ground due diligence, and we strongly recommend visiting any location in person before making business commitments. Our analysis is a starting point, not a substitute for real-world investigation.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, including by adding or removing data sources, changing the MainStreetLens Success Score methodology, updating or rebranding the platform, or suspending Services for maintenance or security reasons. We will provide reasonable notice (via email or in-app notification) before material changes to the Services, except in cases of emergency maintenance or security incidents.

Services and Billing

MainStreetLens offers a free tier that includes three full analyses per calendar month. Free-tier users also receive full heat maps, the MainStreetLens Success Score, detailed reports, and saved searches. Once all three analyses are used, you will be prompted to upgrade to continue. Your analyses are calculated on a rolling monthly basis and do not carry over to subsequent months. We may impose additional reasonable limitations on free-tier usage, such as maximum search radius or number of saved searches. Paid subscriptions provide 20 analyses per month and priority support, billed on a monthly or annual basis. Subscription prices exclude applicable taxes, and you are responsible for any sales, use, VAT, or other taxes associated with your subscription. We may increase subscription prices with at least 30 days' prior notice; if you do not accept the new price, you may cancel before the effective date and retain your current pricing for the remainder of your current billing cycle. From time to time, we may offer free trials of paid features, with terms disclosed at the time of trial enrollment.

We accept payment via credit/debit card and other methods made available through our payment processor (Stripe). Payment information is processed securely and is not stored on our servers. All paid subscriptions automatically renew at the end of each billing cycle until cancelled. You can cancel at any time from your account settings, and cancellation is effective at the end of your current billing cycle. If your payment fails, we may attempt to re-process the payment using the on-file payment method, suspend your access to paid features until payment is resolved, or cancel your subscription after repeated payment failures. We will notify you of payment failures via email. Our auto-renewal practices comply with applicable state laws, and you will receive a confirmation email at the time of your subscription and a reminder before each auto-renewal.

Disclaimers and Limitation of Liability

The MainStreetLens Success Score and all analysis outputs are informational only. They are generated algorithmically based on publicly available and licensed data sources, combined with proprietary weighting models. MainStreetLens does not guarantee that any MainStreetLens Success Score accurately reflects the likelihood of business success at a given location, that our data is current, complete, or error-free, that a location recommended by MainStreetLens will be profitable or suitable for your specific business, or that our analysis accounts for all factors relevant to your particular business or circumstances. You are solely responsible for interpreting our analysis and for making your own independent assessment of any location. We strongly recommend that you conduct your own in-person due diligence before making any business decisions, consult with qualified professionals such as real estate agents, attorneys, or financial advisors before committing to any lease, purchase, or business investment, and not rely exclusively on MainStreetLens's analysis as the sole basis for any business decision. MainStreetLens is not a law firm, accounting firm, real estate brokerage, or financial advisory service. Nothing in our Services constitutes legal, financial, tax, or real estate advice. Our analysis is intended for informational and research purposes only.

The Services are provided on an "AS-IS" and "AS-AVAILABLE" basis. MainStreetLens and our suppliers make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy or completeness, non-infringement, or uninterrupted access. We do not warrant that the Services will meet your expectations, produce specific results, be suitable for any specific use, be free of third-party intellectual property claims, or be available without interruption or error.

To the maximum extent permitted by applicable law, in no event shall MainStreetLens, its affiliates, officers, directors, employees, agents, data providers, or service providers be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, any lost profits, lost data, lost savings, or loss of business opportunity, any cost of procurement of substitute goods or services, any damage to your computer, device, or data, or any errors, omissions, or inaccuracies in the content or analysis outputs. This limitation of liability applies regardless of the theory of liability, whether contract, tort, strict liability, or otherwise, even if we have been advised of the possibility of such damages. In no event shall MainStreetLens's total aggregate liability arising out of or related to these Terms or your use of the Services exceed the greater of the total amount you have paid to MainStreetLens for the Services in the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100.00). This cap applies to all claims, whether in contract, tort, or otherwise.

Our analysis relies on data from multiple third-party sources, including the U.S. Census Bureau, Bureau of Labor Statistics, Google Places API, OpenStreetMap (via Overpass API), SBA and other government agencies, and commercial data providers. While we strive to use reliable and current data, we do not guarantee the accuracy, completeness, or timeliness of any third-party data. Data may be outdated, incomplete, or subject to revision by the original source. We are not responsible for any errors, omissions, or inaccuracies in data provided by third parties.

General Provisions

We may modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of these Terms and notify you via email or a prominent in-app notice at least 30 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Services and cancel your account. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and MainStreetLens regarding your use of the Services and supersede all prior agreements, understandings, or representations, whether oral or written.

Standard provisions that apply to your use of the Services include: if any provision is held invalid or unenforceable, the remaining provisions continue in full force; our failure to enforce any right or provision does not constitute a waiver of that right; you may not assign these Terms without our prior written consent, but we may assign them in connection with a merger, acquisition, or corporate reorganization; the Services are subject to U.S. export control laws, and you agree not to export or transfer them to embargoed countries or restricted parties; we are not liable for failures caused by events beyond our reasonable control such as natural disasters, war, government actions, internet outages, or other force majeure events; our Services may include links to or integrations with third-party services, and we are not responsible for their content, privacy practices, or availability; we may notify you via email, in-app notifications, or website posting, with notices to your account email deemed delivered within 48 hours; and MainStreetLens and you are independent contractors — nothing creates a partnership, joint venture, or employment relationship.

The following provisions survive any termination of your account or these Terms: intellectual property, disclaimers, limitation of liability, indemnification, and general provisions. Our auto-renewal practices comply with applicable state laws, including California and New York auto-renewal disclosure requirements. You will receive a confirmation email at the time of your subscription and a reminder before each auto-renewal.
